Serving the Ohio Secretary of State (22 N. Fourth St.) & Department of Insurance (50 W. Town St.)
Downtown Columbus state agency counter delivery under ORC Section 1701.07(H), ORC Section 1706.09(H), and ORC Section 3927.03
1. Downtown Columbus State Government Intake Counters
When a business entity abandons its listed statutory agent or an out-of-state insurer is sued in an Ohio court, statutory delivery must be executed at the proper state agency counter in downtown Columbus:
| State Government Counter | Downtown Columbus Address | Controlling Statute & Packet Rules |
|---|---|---|
| Secretary of State (Ohio SOS) — Business Services | 16th Floor, 22 N. 4th St. in downtown Columbus (43215) | ORC Section 1701.07(H) (corporations) & ORC Section 1706.09(H) (LLCs); requires quadruplicate (4) copies, prerequisite affidavit, and $5.00 statutory fee. |
| Ohio Insurance Dept. (ODI) (ODI) | 50 W. Town St., Suite 300, 3rd Floor (Columbus 43215) | ORC Section 3927.03; requires duplicate (2) copies naming the exact NAIC-admitted underwriting insurer. |
| Ohio Attorney General — Constitutional Offices | 14th Floor at 30 E. Broad St. (Capitol Square, Columbus 43215) | Civil Rule 4.2(J); required when serving an Ohio state department, board, officer, or Court of Claims defendant. |
2. Two-Step Prerequisite for Secretary of State Service (ORC Section 1701.07(H))
The Business Services Division on the 16th Floor of 22 N. Fourth St. will not accept substitute service on an active corporation or LLC unless the statutory conditions of ORC Section 1701.07(H) or ORC Section 1706.09(H) are demonstrated: the entity failed to maintain an agent, or the agent is no longer present at the recorded street location. If an active Columbus or Central Ohio agent address is still listed, that location is visited first, documents the vacancy on a sworn Non-Est Affidavit, and then walks the four required copies, the statutory affidavit showing the entity's last known address, and the $5.00 fee into 22 N. Fourth Street.
3. Naming the Exact Underwriter at 50 W. Town St.
Across from the Ohio Judicial Center at 50 W. Town St., the Ohio Insurance Dept. (ODI) accepts statutory process on foreign and alien insurance carriers pursuant to ORC Section 3927.03. Note that ODI rejects pleadings that list a generic marketing group name rather than the specific underwriting company printed on the policy declarations page.
